NIHONGO Avenue Terms of Use

Note: This Agreement has been concluded in the Japanese language. The English translation attached hereto is intended for reference purposes only. The English translation shall not be binding on the Parties hereto.

This Agreement applies to all users of services ("Services" hereinafter) provided by the Center for Distance Learning of Japanese and Japanese Issues of the Center for Education of Global Communication of the University of Tsukuba ("University of Tsukuba" hereinafter) via the NIHONGO Avenue content ("Content " hereinafter).

Use of the Services is conditional on consent to all of the provisions of these Terms. Please read these Terms closely and confirm their content before using the Services.

Article 1. Definition

As used in these Terms, the following term shall have the designation indicated below.

User:

An individual or corporation using the Services after having consented to these Terms (referred to in these Terms as User(s)).

Article 2. User registration

User registration is required in order to use the Services. In addition, if information provided to the University of Tsukuba in user registration is incomplete or inaccurate, the University of Tsukuba may reject or cancel user registration.
Those desiring to use the Services must apply for User registration for the Services through the methods specified by the University of Tsukuba and accurately register the information specified by the University of Tsukuba.

Article 3. Usage charges and usage environment for the Services

The University of Tsukuba shall provide the Services to the User free of charge.
However, the User shall prepare, at his or her own cost and responsibility, devices and software necessary and appropriate for use of the Services. The University of Tsukuba shall not be involved in any way with the environment in which the User uses the Services. The University of Tsukuba shall not bear any liability for problems with the Services or harm to the User caused by telecommunications environments.
The University of Tsukuba shall not bear any obligation to take measures such as modifying the Services, even in the event that the devices, software, or telecommunications environment used by the User is unsuitable to use of the Services.
The University of Tsukuba may set or revise usage charges for the Services by notifying the User thereof in advance.

Article 4. Ownership of rights related to the Service etc.

Any and all rights to the Service, including but not limited to copyright and other intellectual property rights concerning its titles, designs, other works, likenesses, marks, information, data, and expressions, are the property of the University of Tsukuba.

Users may not, without the consent of the University of Tsukuba, use information related to this Service for purposes other than those of the Service, for commercial use, whether free or at a charge, or beyond the extent of personal use under the Copyright Act.

Copyright (i.e., all copyright including the rights stipulated in Articles 21-28 of the Copyright Act) to content (i.e., any and all information including still images, video, and text) posted to or otherwise transmitted by Users using the Service is the Property of such Users. When transmitting such content, Users grant to the University of Tsukuba the free and nonexclusive consent to use of such content, both in and outside of Japan.

Article 5. Prohibited acts and refusal to provide the Services

The User is prohibited from engaging in any of the acts enumerated below in use of the Content and the Services.

(1) Use of the Content for purposes other than the intended uses of the Services
(2) Duplication of, decomposition of, addition to, appending to, editing of, deletion of, removal of, revision of, modification of, or otherwise changing the Content, through any form or method
(3) Reverse engineering, decompiling, disassembly, or other analysis of the Content, through any form or method
(4) Transfer or pledge of the Content, or other disposition, licensing of use, etc., whether free or for a charge
(5) Deletion, removal, or other modification, through any method or form, of the copyright statement, emblems indicating ownership, etc. of the Content, or acts detrimental to the good name, trust, privacy, copyright, likeness rights, property rights, or any other rights of the University of Tsukuba or any third party
(6) Use of the Services for unlawful purposes
(7) Intentionally loading computer viruses, computer code, files, or programs designed to impede, damage, or restrict the functions of computer software, hardware, or telecommunications devices, transmitting incorrect information or harmful computer programs, etc. in connection with the Services
(8) Acts that could impede the Services or other operations of the University of Tsukuba
(9) Advertising, promotion, or any other commercial acts or acts of solicitation conducted without the permission of the University of Tsukuba
(10) Posting or providing through the Services overly sexual descriptions, cruel expressions, expressions insulting or detrimental to the good name of or trust in others, discriminatory expressions, expressions encouraging illegality, or other content that is contrary to public order and decency or would make those who view it feel uncomfortable
(11) Posing as another person, acts harmful to minors, acts connected to criminal behavior, stalking, or any other acts of harassing third parties, acts in violation of laws, regulations, these Terms, or public order and decency, acts detrimental to trust in the University of Tsukuba or any third party, and acts disadvantageous to the University of Tsukuba or any third party
(12) Any other acts reasonably judged inappropriate by the University of Tsukuba

Article 6. Interruption or suspension of the Services

The University of Tsukuba may, at its own discretion, interrupt or suspend provision of the Services, in whole or in part, in any of the following cases.
(1) In the event, or possibility, of a fire, earthquake, flood, or other natural disaster, war, unrest, riot, or other crisis, power failure, labor dispute, or other emergency
(2) For periodic or urgent maintenance of servers designated by the University of Tsukuba or other equipment operated or managed by the University of Tsukuba in connection with the Services
(3) When there are reasonable grounds for suspecting the User to have violated these Terms
(4) In other cases in which the University of Tsukuba has judged it to be desirable to suspend operation of the Services, in whole or in part
When the University of Tsukuba suspends or interrupts provision of the Services in whole or in part as described in the subparagraphs to the preceding paragraph, it shall notify Users in advance by posting an announcement to the Content or elsewhere, through any method that it judges to be appropriate. However, the University of Tsukuba may suspend or interrupt provision of the Services, in whole or in part, without posting such an announcement in an urgent case, in a case of force majeure, when necessary for technical reasons, or in other cases as the University judges to be appropriate.
After a User has uninstalled the Content, he or she may be unable to use the Services in some cases. In addition, the University of Tsukuba shall not bear any liability for any damage suffered by the User or any third party in connection with the uninstalling of the Content.
The University of Tsukuba shall not bear any liability for any damage suffered by the User or any third party as a result of the suspension or interruption of provision of the Services, in whole or in part.

Article 7. Handling of personal and other information

The University of Tsukuba shall handle User personal information obtained through use of the Services in accordance with the Privacy Policy established separately on its website (https://www.intersc.tsukuba.ac.jp/~kyoten/privacy/), and the User shall consent to such handling.
The University of Tsukuba may use personal and other information provided by Users for the purposes enumerated below in addition to the purpose of providing the Services (including conducting investigations and other activities as necessary to provide the Services properly).
(1) For confirmation of User identity and notifying Users of changes to charges or the Services and of suspension or discontinuation of the Services
(2) For research and development by the University of Tsukuba (i.e., for uses such as statistical processing, after modifying User personal information so that it cannot be used to identify specific individuals)
In order to achieve the above purposes of use, the University of Tsukuba may entrust User personal and other information to subcontractors who have concluded contracts with the University regarding the appropriate handling of personal and other information. It shall not engage in acts such as provision or disclosure of User personal information to third parties in other cases, except when such disclosure has been demanded by a public agency such as a court of law or a law-enforcement agency pursuant to laws, regulations, etc., or when the consent of the User has been obtained in advance.

Article 8. User Data Deletion

User data stored in this application system can be deleted at the will of the registered user.
To request the deletion of user data, please send an e-mail to the address below. After receiving the request, all data related to the user will be deleted as soon as possible.

Article 9. Advertising

The Services may display advertising from the University of Tsukuba or parties specified by the University, without providing any prior notification to Users.

Article 10. Entrustment of Services

As necessary, the University of Tsukuba may entrust the Services, in whole or in part, to third parties.

Article 11. Device-identifying information and location information

The University of Tsukuba shall not collect information identifying specific individuals or devices through the Services.

Article 12. Measures upon termination of the Services

If the University of Tsukuba has determined that a User has violated any of the provisions of these Terms, it may refuse to allow the User to use the Services. The University of Tsukuba shall not bear any liability for any damage suffered by the User or any third party as a result.
The provisions of the preceding paragraph shall not impede the University of Tsukuba from exercising its right to demand compensation from the User for any damage suffered as a results of the User's violation of the provisions of these Terms.
The provisions of these Terms shall remain in effect even after the release or cancellation of the Agreement between the User and the University of Tsukuba consisting of the provisions of these Terms, or the termination of the Services.

Article 13. Limitation of liability

The University of Tsukuba makes no guarantee to Users or third parties regarding the completeness, accuracy, certainty, usefulness, freedom from defect, freedom from error, etc. of the content of the Services or the content of information obtainable via the Services. Users shall use the Services at their own discretion and under their own responsibility.
In the event that a User has caused harm to a third party (including other Users) through use of the Services, then the User shall resolve such harm at his or her own cost and responsibility and shall not cause any harm to the University of Tsukuba.
The University of Tsukuba shall not bear any liability to Users for damage arising through provision of the Services or caused by acts committed by the User or the University of Tsukuba in accordance with these Terms (including but not limited to damage arising from problems in or failure of the Content, problems in or failure of User devices arising as a result of installing the Content on such devices, or carelessness on the part of the User while using the Services, as well as changes to, interruption of, and suspension of the Services or disputes in commercial transactions).
The third-party content providers themselves are responsible for the content of third-party content provided by the University of Tsukuba through the Services, and the University of Tsukuba makes no guarantee regarding third-party content and is not obligated to confirm matters such as the factuality of such content.

Article 14. Separability

Even in the event that any of the provisions of these Terms has been invalidated, the other provisions of these Terms shall remain fully in effect.

Article 15. Compensation for damage

In the event that a User has caused harm to any third party in connection with use of the Services, such harm shall be resolved at the cost and responsibility of the User, and the University of Tsukuba shall not be inconvenienced in any way as a result.
The University of Tsukuba shall not bear any liability for disadvantages or harm suffered by a User or a third party in connection with use of the Services.
The University of Tsukuba shall have the right to demand compensation for any harm that it has suffered as a result of the violation of any of the provisions of these Terms by a User.
While the site through which the Services are provided may include links to external sites, the University of Tsukuba shall not bear any liability for any disadvantages or harm suffered by a User or a third party due to use of such external sites.

Article 16. Compliance with laws, regulations, etc.

In addition to these Terms, the User shall comply with laws, government ordinances, ministerial ordinances, regulations, rules, orders, etc. applicable to use of the Services.

Article 17. Applicable law and court of jurisdiction

These Terms shall conform to the laws of Japan. In addition, the Mito District Court or the Tsuchiura Summary Court shall be the exclusive court of first instance for any dispute arising between the University of Tsukuba and the User with regard to these Terms or the Services.

These Terms shall take effect and implemented beginning March 23, 2020.
